JUDICIAL REVIEW
For nearly three years, we have been opposing a planning application to build 250 houses on farmland adjacent to Faversham on an area called Ham Marsh. We are opposing this application, not because we are against housing, we know that there is a housing shortage and people need homes. We oppose this plan because it is in the wrong place, and overrides the Faversham Neighbourhood Plan, approved by referendum in 2024. Furthermore, there are substantial problems with surface water drainage such that the site will need 're-profiling', (raising land levels by adding tonnes of soil) and the proposed drainage channel passes through farmland that is not owned by the developer. More significantly, surface water run-off would flow into adjacent RAMSAR and SSSI sites.
In January 2026, approval was given to take our case opposing the development to judicial review, which will take place in June. Our costs are estimated to be £66-70k. Working in partnership with the Faversham Town Council, the Faversham Creek Trust and the Faversham Society, a substantial sum has already been pledged and the gap to close is about £25k.
